terms and conditions

Area of application
All supplies, shipments and attainments are under the following policies and procedures. If any customer will send aberrant policies to tne-systeme UG (haftungsbeschränkt), tne-systeme UG (haftungsbeschränkt) must not obey to this / these. If the customer will send an order he accepts our policies and procedures automatically.

Pricing
Our prices are prices ex works. Our prices do not include shipment and packaging costs, further called p&p. The p&p must be paied in advance by the customer. The prices are subject to change and without obligation up to the day of delivery.

Self pickup
is possible any time w/o any additional costs, the customer must make a collection date with tne-systeme UG (haftungsbeschränkt) 5 work days before.

Payments
Supplies and shipment only after advanced payment, customers should use Paypal or our bank account. Bank data will be given via e-mail. Customer must pay the transfer costs, please check before ordering.

Shipment
The order will be shipped at the expense and risk of the customer. p&p costs include the costs of the shipper plus packaging costs. Each single package will be shipped with shipping insurance inside or outside EU with Hermes, Deutsche Post, DHL or others.

Supplies
Dates and delivery periods specified by us are not binding. Parts in stock will be shipped normally within 5 work days. Parts not in stock or custom made parts on customer’s request will take up to 21 days until shipment.

Warrant
We warrant our products for workmanship and material for up to 24 months after purchase. Please keep your receipt as we are accepting warranty claims with proof of purchase only. Warranty claims can only be done by the original purchaser. If you can determine that a product is defective before using it, we may be able to accept it back for exchange or refund; before taking any action tne-systeme UG (haftungsbeschränkt) has to be contacted / informed.

Damaged returns
Damaged merchandise includes items that have been damaged in shipping. If a shipment arrives at your door with apparent shipping damage, please refuse the delivery. If you have already accepted delivery and then find shipping damage, please contact us at info@power-spark.de immediately. Save all products shipped, packaging material and paperwork; do not throw anything away or dispose of any items in the package in any other way! If you attempt to return the merchandise yourself, you will jeopardize our chances of making a claim, and you may not receive credit for the return. In most cases, your entire shipment needs to be examined by the shipper for a successful claim.

Limits of responsibility
We can not accept any responsibility for crash damage, physical injury to you or others, and/or loss of kits, engines, accessories, etc. incurred by any of our products. In most cases it is very difficult or impossible to determine whether crash damage was actually due to radio equipment failure or to operator error. Also, we cannot be held responsible for any purchased components that are incorporated into radio systems or problems caused by incompatibility between radio components, parts, and repairs not completed by our service center, etc. We strongly recommend obtaining liability insurance through national organizations such as NAMBA or IMPBA in US, or elsewhere before running any model boat to limit your liability. Please comply with local ordinances. Our products are no toys!
All of the products we sell are intended for retail consumption by our customers and are not intended for resale. The tne-systeme UG (haftungsbeschränkt) Satisfaction Guarantee is not transferable. Any consequences arising out of the resale of merchandise purchased from tne-systeme UG (haftungsbeschränkt) is the responsibility of the seller, not tne-systeme UG (haftungsbeschränkt).

Court jurisdiction
Location for deliveries and performances is Aalen. Location of jurisdiction for all disputes arising from this contract is Aalen. It is governed by the laws of the Federal Republic of Germany.

Cancellation of orders / right of withdrawal

You have the right to withdraw from this contract within 2 months without giving any reason. The withdrawal period will expire after 2 months from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right of withdrawal, you must inform us tne-systeme UG (haftungsbeschränkt), Mr. Tibor Niedermayer, Wehrleshalde 38, 73434 Aalen, Tel 07361-9806027, E-mail: info@tne-systeme.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). If you use this option, we will communicate to you an acknowledgement of receipt such a withdrawal on a durable medium (e.g. by e-mail) without delay. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion respectively early termination of right of withdrawal

You do not have any right of withdrawal for goods, which are not pre-fabricated, pre-produced or pre-assembled and which have been produced, fabricated or assembled on your request and / or order.

Development is running every single day so technical and or optical changes may occur.
